US Judge Mandates Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.
The case originates in a mistaken deportation to El Salvador in March, which the government later acknowledged was an mistake. After his repatriation to the United States to answer human smuggling charges, he was held in immigration custody.
In her order, the judge noted that the authorities does not have a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
